The CPC Central Committee decision,which pushes forward some major issues concerning rural reforming and development ,has been passed in the Third Plenary Session of 17 in 2008 .It definitely pointed out that it is necessary to establish a unified construction land market, containing urban and rural construction land. The construction land of rural collective, which obtained in accordance with the law ,must be transferring in the visible unification land market in order to regulate the way of land-use right transfer publicly. And under the premise of programming , rural collective possess equal rights to the state-owner. At the same time, Ministry of Land and Resources announced a design about developing agriculture, increasing income of farmers and promoting the co-ordinating development between urban and rural area. It expressed definitely that the way of t land-use right ransferring about rural collective construction will be come on recently. What is more, the collection and distribution system of rural construction land taxes will be established in the future. However, in the three decades of reforming and opening up, most parts of the rural collective construction land in the state had been non-transferring. The circulation is only in one way, that is the national collection. Only the direction of flow to the state-owned rural land for construction purposes, construction land in rural areas have no secondary market. This aspect has led to the delayed development of construction land market in rural areas and the division between urban and rural land market and the inequality between collective ownership and state ownership and so on. The unfair process of transfer price determination and income distribution is harm for rural collective and farmers. On the other hand, some of the collective or the farmers set out from the max interest, and they trade the land privately. It will seriously influence the development of state-owned land market. Therefore,the study of rural collective construction land market transfer mechanism is of great significance to implement the central policies and address related issues in rural areas and the establishment of a unified construction land market for system urban and rural.In this paper, through referring a large number of available documents, with using a combination of theories and practices , summarized by means of interpretation of the collective construction land use right transfer mechanism of the construction of a more in-depth studies. First of all, make an analysis of rural land for building the background and significance of the circulation, and make the application of market economy, institute economics of rural land for construction of the relevant theory of the circulation, from Chinese market system, the integration of urban and rural areas and farmland protection analysis of rural collective land for construction of the needed for circulation.Analysis and summarized current rural collective construction land use right transfer characteristics of China, identify and summarize the flow of rural collective land for construction of barriers and motivation factors, obtain land for construction of rural circulation of the main obstacles is the lacking of legal support, property rights are unclear, unfair distribution of benefits and adverse government regulation and other issues, and put forward a socialist market economy and the inherent requirement of self-development, national policies, as well as the loosening of the existing transfer system, and the existence of the profit potential of rural land for construction is a strong driving force for the circulation.Based on the above analysis, in order to improve the transfer market mechanism of rural collective construction land, the rural collective land for construction should follow the principle of circulation and circulation of the normal operation of security constraints,we should build a transfer pricing mechanism, income distribution mechanisms and the government regulation mechanism to improve the legal system, at the same time,clarify the collective land property rights, this land reform scheme to regulate the use of the proceeds raised to ensure the healthy operation of the mechanism of the supporting system of reform.The creative points of this paper are as follows: First, break the intrinsic transfer pattern of rural collective construction land, which only transfer to China's state. Then based on socialism market theory and the same terra has the same price, this paper establishes the market mechanism of first and second-class transfer and shows the coordinated reforms.At last puts forward the viewpoint from the angle of land-market fairness and land property theory ,which means the collectivity and state ownership are equivalence and the correlated main-body should take the reasonable property rights.
