Research On The Compensable Use System Of The State-owned Land

1988 edition and both give recognition of selling and transferring the land use right,and the compensable use system of the state-owned land is also clearly defined.So the compensable use system of state-owned land is formally established.The system is very important in preventing the state assets and the arable land and so on.Currently,we are still finding a way to set up the country-wide land market,but there are still lots of problems to be solved,including the existence of hidden land market,the supervision of the aution and bid,the mode of compensable use,ect.The land rent theory and property right theory of economics provide the basic theory of using the state-owned with compensation.The great achievements in the past two decades tells us that the system is suit for our country now.At the same time,we need to realize that there are still shortages exist in the law about it. And during the period of researching the practice of the system,we find that although there are rules of transfer mode and specific procedure for the transfer of land use right, transferring the land with protocol still widely exists.Also there are lots of illegal transations during the circulation of the land because of the participation of allocated land,the existence of hidden land market causes big influence to the normal order of land transacitions,at the same time,it causes the loss of large quantity of the state assets.It is only we find the problem that we can solve it,so after researching the laws and the practice of the system,we finally find the reasons,including imperfect of legislation,inadequate enforcement,imperfect matching system and so on. It is suggested that we should strengthen the law enforcement about the mode of land transations,forbidden the transations of the allocated land and set up the matching system of land market.Finally,as the blue land of our country,the use of sea area also carries out the compensable use system.There are similarities between the compensable use system of the sea area and the state-owned land.So,after the introduction of the compensable use system of the sea area,we provide ideas of how to promote the mutual learning of the land granting fee and transfer forms between the compensable use system of the sea area and the state-owned land.We hope that thought the theory discussion,we could provide ideas of improve the compensable use system of state-owned land, strengthen the regulation of the land market,achieve the goal of reformation of land use system,ect.
