Study On The Classified Reform Of Allocated Land Use Rights

In nearly 30 years from the completion of Socialist Transformation to Reform and Opening-up, the allocation of land use rights system had been the only form of state-owned land supply and management in China.After the Reform and Opening-up, land granting system has been established, thus forming a double track system which allocted land use system and granting-land use system coexisting. The double track system can be regarded as a land supply and management mode with the coexistence of administrative intervention and market instruments.However, the public welfare allocated land-use rights and the profit-oriented allocated land-use rights exist all at once because the unreasonable scope of allocated land-use rights and poor management. The profit-oriented allocated land-use rights does not comply with the current public welfare purposes of allocation of land use rights, easy to cause problems that the urban land use is inefficient, invisible land market spreads and so on. Therefore, there is an urgent need to improve and perfect the existing allocation of land use rights system.Firstly, this paper discusses the value of the allocation of land use rights system, then analyzes the main problems in the allocation of land use rights system. This paper divides allocated land-use rights into the public welfare allocated land-use rights and the profit-oriented allocated land-use rights after discusses the scope of the allocation of land use rights. At last, this paper puts forward a different reform strategies. The main conclusions in this paper are as follows:(1)As the socialist market economic system reform continues to deepen and the marketization of urban land to be improved constantly, allocated land-use rights still has the necessity of existence, able to effectively make up for the failure of market mechanism in the allocation of public welfare and. (2)The first thing to improve and perfect the allocation of land use rights system is distinguishing the scope of the public welfare allocated land-use rights and the profit-oriented allocated land-use rights.The ultimate goal of classified reform of allocated land use rights is establishing a new double track system. (3) The formation of profit-oriented allocated land-use rights has a special historical background and a degree of rationality. Therefore, it is optimal to transform the allocated land-use rights to the granting land-use rights through the way of market reformation. (4) It is optimal to retain the public welfare allocated land-use rights, and in order to ensure public welfare value, the public welfare allocated land-use rights should be imposed more stringent management.
