Improving The System Of Real Property Management In China From The Nature Of Property Management

Nowadays, there are lots of issues in the real property management because of all kinds of elements. In this dissertation the writer will discuss these problems and improving the system from the nature of the real property management. The nature of the real property management is the key of this thesis. Whether analyzing the present situation or improving the system of real property is from this angle.The first chapter is about the conception and the nature of the real property and the real property management. There are two parts in this chapter. The first part is about the conception of the real property and the real property management. In the second section the writer firstly introduces the nature of the real property, then analyses the nature of real property management from this nature.The second chapter is concerning the problems in the system of the real property management. The first section is about the situation of the development of the real property management. In the second part the writer research the problems of real property management from the nature. In this part three problems are summarized by the writer: 1. the relation among the obligations of the real property service corporations is not clear and the obligations which are arranged by the owner and the real property service corporation are not the core. 2. the government gains too much power of punishment which may affect the real property management from the law. 3.the problems in the system of the real property service contract such as the problems in concluding, removing and the sample contract.The third chapter is about the reconstruction of the system of real property management in China. In this chapter the writer firstly summarizes the basic principle in real property management: autonomy of will, considering the relation among the individual interest, collective interest and public interest, suitable invasion of government. In the second part, the writer suggests some methods to improve the system of real property management: decreasing the obligation of real property service corporation coming form the law, clarifying the relationship between the obligations coming from the negotiation and the commission, decreasing the punishment power of government, improving the system of real property service contract.
