Land is the essential resource and means of production for human' s existence and development. In recent years, a large amount of rural collective lands have been transferred to state's construction land via commandeer as industrialization and urbanization are developing. With the transformation from planned economy to market economy in China, the land's potential value is starting to be recognized and identified. It is very popular in the world that the government makes are quisition of private property for public interests, which is the radical embodiment of application of the expropriation right. Just on this foundation, Chinese land expropriation system has been founded. Nowadays, however, land expropriation is more used for the land owned by collective in our country. In other words, when a nation needs using collective land for construction, the land will be expropriated and then belong to the nation. The former possessor and user of the land can get some compensation from the government according to the law. The land expropriation system, which was developed under the planned economy, has exhibited many disadvantages gradually in the market economy. For instance, compensation for land acquisition standard is under debate and distribution of income is another unraveled issue, together with privately illegal land trade and range of land acquisition. So it is necessary to make a deep discussion and study on this question, analyze its deep reasons, find a viable way to resolve it in current condition, and then improve the land expropriation system in theory and in practice. This article utilizes the economic analysis principle to form theabove question the system factor to carry on the analysis, so as to make some suggestions to cope precisely with land acquisition. The viewpoint is listed as follows:1. According to the discrepancies between compensation standard of land acquisition and income distribution, privately illegal land trade and range of land acquisition. The present system of land acquisition cannot cater for urbanization and economic development.2. The ground of the commotion of compensation standard of land acquisition lies primarily in undeveloped property right of collective land. Unfairly distributed revenues result in the fact that property right of collective land is vague and exclusive. The reason of privately illegal land trade commonly existed is that private trade is less cost than open issue. The range of land acquisition is too wide are subject to stagnant state of our nation's system of land acquisition effected by macro-planed economic policy, which, as it is, requires improving.3. We have to make up any regulations and statutes for implement concerning how to perfect the system of current land acquisition, to delimit rigorously the property right of collective land clearly, to implement the right of distribution of incomes, to discern the public beneficial and non-public beneficial commandeer, and to set up marketing collective land.
