The Study On Land-lost Peasants' Protection Of Interests In Urbanization Progression

With the fast advancement of Chinese industrialization and urbanization, a great deal of peripheral farmland of cities and towns has been expropriated. More and more peasants gradually lose original land, have become a crowd of people without farmland, work or social security, and they have been dissociating between cities and countryside, and they have been a throng of new type disadvantaged group. The land-lost peasants'interests have been damaged gravely, and the subsistence and development of them have been evolving an attention social problem in China.Through the study of Land Management, Land Economics, legal theory and so on, using research techniques including direct investigation, indirect investigation combination, visit and questionnaire survey combination, criterion analysis and empirical analysis combination, crosswise research and longitudinal research combination, this paper has made an empirical investigation and analysis on the whole existing status of the land-lost peasants in 2 suburbs of Zhengzhou City. The results shows that the majority of land-lost peasants in China, including in Zhengzhou City, their interests have been encroached seriously and suffered from massive profits loss. They are all facing the problems that expropriation compensation standard is excessively low, living standard drops, the unemployed personnel increases largely, social security is lack.The paper tries to seek the reasons that results in much loss of interests for many land-lost peasants from the related system angel. The causes includes several items: the deficiencies in land expropriation system is the direct cause; for land-lost peasants, the flaws of rights and interests protection system and the lack of social security is also an important factor.Combined with the basic national condition, the paper puts forward some countermeasures and suggestion to protect the interests of land-lost peasants:Consummate the land expropriation system, define the scope of public interests clearly, strictly restrict government behavior, perfect the procedure of the land expropriation, set up reasonable land expropriation compensation mechanism; consummate land-lost peasants protection of right and interests mechanism including correctly locating local governments roles, establishing mechanism of expressing the interests for land-lost peasants; establish the government-leading social security system, including the lowest live guarantee, old safeguard, medical insurance, work insurance and law assistance, etc.
