Research On The Legal Regulation Of Rural Labor Transfer Based On Sustainable Development In China

Comrade Mao Zedong said China's problem is the problem of farmers, basically speaking. China is a large agricultural country, agriculture is the foundation of the national economy, farmers are the key to agricultural development, sustainable development of agriculture is the basis of sustainable development for the whole society.Sustainable development require the coordinated development of population,resources and environment, the key is development of human. China's rural population is major, arable land per capita is little, agricultural productivity is low, rural surplus labor is large, and all of these problem have become the serious issue ,which have a strong impact on the modern agriculture and the whole economic sustainable development. The transfer of rural labor force is an important way to solve the problem of rural surplus labor force, is the heart of China's modern agriculture in sustainable development and the whole social harmony. How to achieve the sustainable development of the transfer of China's rural labor force, legal regulation is the most effective protection in the economic market conditions. Especially in economic law, as "Social responsibility-based law,Overall interest of the community-based law,Social law,Adjust social publicly relations of the coordinated development law", have the responsibility to undertake the mission of resolving the issue of legal protection for transferring the rural labor force . Sustainable development is the primary purpose value of modern economic law of, also our country's development objectives, and the biggest problem in the transferring rural labor process is immediate and long-term interests, local interests and the overall interests ,the contradictions between economic development and social harmony sustainable development, in order to fundamentally solve this problem, in addition to economics, sociology theory, the most effective is the economic law's regulation.In the study, first of all, I from the basic concepts, the basic status to explore the connotation and extension of transferring rural labor force, analysis the basic status of China's transferring of rural labor force, to reveal the dialectical relationship between the transferring of rural labor in China and the sustainable development, make the foundation for further study. Secondly, to explore theoretical basis of legal system in transferring of rural labor force. Mainly based on State intervention theory, to explore the economic basis in transfer of rural labor force; based on the population migration theory, to explore the sociologic theoretical basis in transfer of rural labor force; based on the theories of the right to life and the right to development, to explore legal theoretical basis in transfer of rural labor force. On this basis, to reveal the transfer of rural labor force of China's sustainable development and the inevitable of legal regulation. This study provide a theoretical basis for the legal regulation of transferring of rural labor force.Third, make empirical analysis and comparison for the transfer of rural labor force of China's legal system. By empirical analysis, revealed the legal system status and institutional root of the transfer of rural labor force, through the comparative analysis to explore the kernel of the transfer of foreign labor laws and reasonable regulation of, combined with the reality of our country to learn from. This study provide practical legal basis for the transfer of rural labor force.Finally, in accordance with the theoretical basis and practical basis, make the basic framework for the China's legal system of regulation in transfer of rural labor force to. Including the choice of system, the purpose of the principle of institutional design, construction of the system in the law of transferring of rural labor law, especially legal protection of China's regulations law operation in the transfer of rural labor force , so as to ensure the sustainable development of the transfer of rural labor force.
