With the rapid development of our society and economy, land resource shortage is becoming the hindrance to further development. In the condition of supply shortage, how to allocate the limited resource appropriately is to be the effective way to deal with the contraction of economy development and cultivated land preservation. However, as the means of construction land quota allocation, land use planning, land use annual plan and land use control system don't work well. Oppositely, construction land expands out of control of land use planning and land use control system because of the existence of land use annual plan, more seriously, it also brings other problems. Therefore, this paper's purpose is just about to probe into present allocation model of construction land through the case study of Zhejiang province, point out its deficiency and provide corresponding improvement advices.First, this paper anatomies present allocation model of construction land quota of China, point out that land use planning, land use annual plan and land use control system are the primary systems of present allocation model of construction land quota of China. Then, analyses about the above systems through the case study of Zhejiang province, figures the deficiency of each system, and considers land use planning and land use control system are essential systems on land use management. Whereas, construction land expands out of control of land use planning and land use control system because of the existence of land use annual plan, and that land use annual plan can't achieve optimal allocation of construction land, neither achieve the purpose of cultivated land preservation, in other words, land use annual plan isn't essential.Second, this paper analyses reactions,primarily are land use planning modification for regionalism adjustment and innovation of land institutions, that Zhejiang province take for allocation failure of construction land, and point out deficiency of land use planning, land use annual plan and land use control system fatherly. So it should improve land use planning formulation and build up authority of land use planning. On the other hand, market mechanism will bring off optimal allocation of construction land.Third, this paper interprets the allocation failure with some theories, and point out that the instructional thinking that preserve cultivated land around cultivated land quantity preservation isn't rational so that it deteriorates allocation failure more seriously, and so does land finance. Last, this paper provides it should change the concept from cultivated land quantity preservation to cultivated land quality preservation, and cancel land use annual plan, adopt a allocation model of construction land by land use planning and market mechanism, and strengthen legislation simultaneously.
