Nowadays, there are many problems in Chinese construction market, such as bad quality and non-payment, which are costly related with bad performance of consrtuction contract.The introduce of construction guarantee system, increasing the main responsibility of breach of promise, increasing costs and punishment strength, which can effectively solve the above problems and regulate the construction market. The construction guarantee refers to the construction activities, the guarantor to the contract party provide a suretyship contract, the other party to perform its obligations under a contract, if the warrantee fails to fulfil his contractual obligations, it will be performed by the guarantor. The implementation of project guarantee system is late in our country, and many places are still not perfect. This paper bases on the analysis of the comparison between China and international construction guarantee system, and puts forward the current situation and improved measures of construction guarantee. To define the subject of construction bond, the guarantor may be the bank,professional guarantee company and insurance company, which are registered in the People's Republic of China. Also pointing out that at present our country should adopt the guarantee for high forehead conditional mode, guarantee company will take full responsibility to make for implementation of construction guarantee.Our cuntry has a number of cities and regions which have carried out the construction guarantee and have also been success. The paper analyzes our country's guarantee system of construction project has some problems which are existing during the process of guarantee. These problems are lack the admittance threshold of security market; the rate of collateral charge is not unite; the credit agency hasn't be established completely; never supervise after guarantee; puting forward corresponding countermeasures to solve these problems: setting up the market access condition; standarding construction project warranty costs; use effective type of guarantee; and makecredit checking to contractor.
