The Research On The Status And Problems Of Xiamen Rural Land Transfer

In recent years, with the rapid development of the rural industrial structure adjustment and industrialization of agriculture, the size and scope of land transfer also have been expanding. Rural Land transfer is the product of the development of productive forces to a certain stage. Since the introduction of the household contract responsibility system, agriculture and the rural situation has changed dramatically. With the industrialization of agriculture, markets and rural industrialization and urbanization continues to accelerate, the use right of farmers contracted land transfer has become increasingly active. In many places, for farmers, it has become an urgent requirement, but there are some problems that have gradually emerged. this thesis based on the study of Xiamen, analysis the situation of rural land transfer to obtain the following results:(一) The characteristics of rural land transfers in Xiamen are:(1) The total amount of the transfer took shape (2) The form of land transfers has been diversified according to local conditions (3) The business form of land transfers has been diversified (4)The legal system of transfer has been mechanism and market-oriented.(二) The basic motivation of the rural land transfer in Xiamen are:(1)Scattered, piecemeal contracted land is not conducive to farming; (2)Traditional agricultural practices great risk, with low effectiveness. (3) The space for employment and income of farmers broader avenues. (4)The strategic adjustment of agricultural structure and promote the industrialization of agriculture.(三) For the current rural land transfer,the main problems are:(1) Incomplete land property rights restrict the right to land contractual management transfer fundamentally (2)Publicity about the transfer policy is not in place; (3) Inadequate social security system in rural areas limits the transfer of the right of rural land contracting and management; (4) Transfer of land between farmers lack of restraint mechanism; (5) Land transfer process is non-standardized and always disputed(6) It's hard to co-ordination the conflicts of interestamong some farmers (7)The anti-rent flow of expected future Daobao underestimated.To solve the problem, this study proposes a system innovation ideas are: (a)Advancing with the times in exploration and innovation, strengthen leadership over the work of land transfer (2), Guidance according to local conditions and do the coordination of land transfer services; (3)Increase the institutional building on the promotion of land transfer standard management according to law; (4)To put by something for a rainy day, encourage the promotion of land transfer solid form; (5) Create a good social environment for land transfer.
