Compensation Mechanism And Safeguard Measures Of Agricultural Land Expropriation In Changchun Northern Area

In the past decades, great changes have happened in our country’s economy.More and more farmers’ land has been served in the industrialization and urbanization.Governments at all levels have been organized to carry out a series of land acquisition activities,one after another. In the acquisition of a large number of new construction sites, but also exposed some problems in the work of land acquisition.For example, the farmers’ land property rights are not protected, the purpose of land acquisition is not clear, the land acquisition procedures are opaque, landless farmers are not placed properly and so on.The paper takes farmland expropriation of Changchun Northern Area as an example, which carries on the empirical analysis and the theory discussion to the current land expropriation compensation, the distribution of the land property, the current situation of the sustainable protection of the land expropriation. This paper is divided into five parts.Chapter 1, induction and analysis of correlation theory. Introduced research background, significance, method and content, and introduces the domestic and foreign about land expropriation situation, including research on the public interest in land acquisition process, some research results of land expropriation compensation and social security and other aspects.Chapter 2, introduces the concept and characteristics of land expropriation, the mechanism and the mechanism of land expropriation. This chapter introduces the theory, including the theory of property rights and land value-added income distribution theory and social security theory. All these have laid the foundation for the research of Changchun Northern Area’s land expropriation mechanism.Chapter 3, this paper mainly analyzes the land property rights of farmers in the Changchun Northern Area. We through the Changchun Northern Area land acquisition research, analysis to what form, to the extent that the farmers can recognize the land property rights. The main content of the study includes four parts, the construction of land property rights, land value increment income distribution rights of land acquisition, analysis of land use right and the analysis of land contract management right.Chapter 4, according to the social security situation of landless peasants in the Changchun Northern Area, the land income distribution rights of landless peasants, pension, medical insurance, employment security are analyzed in that four aspects.The research has a general orientation to the identity of the landless peasants, points out the existing problems, and puts forward the measures to improve the sustainable social security of landless peasants.Chapter 5, the problems and measures to improve the land acquisition system in the Changchun Northern Area. The problems include:land expropriation law is not perfect, land expropriation procedures transparent, the purpose of collecting is not clear, the lack of social security of landless peasants, unreasonable compensation. Measures including improvement land laws, raise farmers land acquisition compensation standards, from the "two party talks" into "multilateral talks", the government issued land development plan ", for more than 50 years old farmers with" a serious illness insurance, and conversion in advance, promoting employment and so on the concrete countermeasure to solve.
