With the development of China’s economy, people’s living and consumption level is getting higher and higher, but at the same time there is a large number of domestic waste every day, and waste treatment facilities can not keep up the pace, so more and more Chinese cities have fallen into the difficult position of garbages siege in. Therefore, government departments are facing the more and more pressure to realize the garbages disposal of harmlessness, reductions and resource. But garbage disposal plants are also the major source of pollution, are typical of NIMBY facilities, and trigger even NIMBY conflict problems. In addition, discrimination problems in the site selection process is worthy of attention and research.In our country, the legal system of garbage disposal plants sites selection is in a dilemma, the failure to establish the location information opening to the public, the public participation and expert neutral system and so on. It is not conducive to solve the NIMBY conflict and discrimination problems in the site selection process, and is also the performance of lack of space, environmental and procedural justice. Although China has implemented the "Environmental Impact Assessment Law", but the environmental impact report system on garbage disposal plants also encountered some problems in the implementation process. Through the analysis and reference on the sites selection institution of New York city NIMBY - the Fair Share Criteria, then preliminarily putting forward the system to to overcome NIMBY and site selection discrimination in our country. It is mainly involved in the system of information disclosure and public participation which includes the consensus building process, supervision committee system, the neutrality of the expert system, the site rule of quantitative method, and perfecting the environmental compensation mechanism.
