| Water is the material basis of all life survival and development and the lifeblood of existing and lasting of human. Water is a kind of irreplaceable and indispensable material which is closely connected to people’s daily life, economic development and social stability. It is also an important foundation for the sustainable development of economy and society. With the society and economy developed rapidly, human have more requirements on quantity and quality of the water. Over-exploitation of water resources has led to the intensive water crisis, what’s more, water pollution has been increasing accidents, these events cause the quality of living environment of human falling down continuously. Worldwide drinking water crisis caused by water shortages and pollution has become more an more prominent, and protection of drinking water has become the common focus of the world. With the development of human society, the improper use of environment and resources leads to the deteriorative relationship between human and environment and resources shortage. Water shortages, especially a shortage of drinking water resources, have become the important factors restricting the development of some places. In the process of China’s socialist modernization, it also appears appropiately problem of drinking water sources. Pollution of drinking water which have an serious effect on people’s health and life safety sources, causes drinking water shortages and water quality deteriorate and leads to the occurrence of some diseases associated with drinking water.Rational development, utilization, and protection of drinking water source is currently the main task of the world and also the most important issue of national environmental management. America enacted protection law of drinking water sources very earlier and has more comprehensive legal framework. In recent years, although China has gradually issues several laws and regulations related to drinking water, water pollution incidents also have occurred. So legislation still need to be further improved. In this paper, I compare the legal protection of drinking water sources between China and America and provide a reference for our legal protection of drinking water sources. I also analyze the status quo of legal protection of drinking water sources from legislation and management system aspect, and get the conclusion that water quality standards are not perfect, that the management system is uncoordinated, that system of protected areas and emergency system are imperfect, and that legal liability is insufficient. Further more, I analyze and summarize the current situation and feature of legal protection of drinking water sources in America, and compare the water quality standards, management systems, system of protected areas, emergency response system, and legal liability between China and America. Basing on this analysis, I sum up that in order to complete our country’s legal protection of drinking water sources, we should try our best on five aspects:water quality standard system, management system, system of protected areas, emergency handling system, and legal responsibilities. |
