| Located in East Asian monsoon area, China is one of the countries that most severely affected by meteorological disasters with great varieties, high frequencies and wide coverage. Recently natural disasters frequently occur in China, which make people concentrate on the management and prevention of meteorological disasters. To reduce harm to people's lives and properties is the focus of the research.Based on this, the paper analyzes the necessity and foreign experience of the legalization of the national management and prevention of meteorological disasters, expatiate on the achievements and problems as well, in order to find out how to perfect laws and regulations and improve the capability of the national management and prevention of meteorological disasters. It is divided into introduction, major content(further divided into four parts) and conclusion.Introduction: the author introduces the situation concerning the management and prevention of meteorological disasters and elaborates on the purpose of this paper.Part one of the major content: Through describing the concept, kind, characteristics of meteorological disaster, the author states the background of formulating laws and regulations on the management and prevention of meteorological disasters and explains the significance of improving the capacity of preventing these disasters in the disasters control and relief, the protection of people's asset and safeguarding economic development and social stability.Part two of Major content: The author analyzes the management and prevention system of meteorological disasters in China and other countries. After the outbreak of SARS, China has paid increasing attention to the Emergency Management System for public emergencies. In terms of Emergency Management Model for unexpected meteorological disasters, China still lags behind U.S. Japan and Russia. The System of China appears to be too administrational and short of prevention, prediction and collaboration. Particularly, when collateral events of disasters transcending regions arise, China's single emergency model proves inadequate in handling such emergencies. Therefore this is an urgent need for China to build a comprehensive, scientific and manageable management and prevention system of meteorological disasters Part three of major content: This part mainly analyzes the legislation of management and prevention of meteorological disasters in our country. It's a transformation from administration to legislation with the promulgation of Law of the Peoples Republic of China on Meteorology as a sign. After that China enacted Artificial Weather Modification Regulation(2002), Emergency Response Law of the People's Republic of China(2007),National Meteorological Disaster Prevention Project(2009), National Meteorological Disaster Prevention Programming(2010) and Meteorological Disaster Prevention Regulation(2010). The adoption of these laws and regulations on the management and prevention of meteorological disasters has optimized the previous legal framework, signifying the initial formation of China's legal system of managing and preventing disasters which is an important part of Socialism with Chinese Characteristics.Part four of the major content: the author dwells on the advantages of legalizing the Management and Prevention of meteorological disasters. The adoption of related laws and regulations make rights, obligations and relevant procedure clear, which will promote the development of disaster prevention capability and the degree of legalization. Since the beginning of the century, China has promoted a series of measures to combat meteorological disasters, which has played a central role in disaster relief and control. Problems also arise in the implementation of relevant laws and regulations as the legal framework is still under construction. These problems call for urgent solutions. Conclusion: China's legal framework for the management and prevention of meteorological disasters has basically taken shape. In order to ensure the social substantial results, it still takes time for these laws and regulations to be fully materialized, for the management and prevention of meteorological disasters to be officially legalized and to develop and be perfected continuously. |
