Legislation,supervision And Effect: The Research On Jiangxi Provincial Assembly In Late Ch'ing Dynasty

Jiangxi Provincial Assembly is the product of Ch'ing dynasty's preparation of constitutionalism. Although the Ch'ing government defined it as "counseling setup", "auxiliary setup", it is the imitation of western democracy mode in form. The establishment of Jiangxi Provincial Assembly made local constitutional setup appeared firstly in history with certain legislative power and superintendence, broke the enclosed structure of feudal regime, made the original administrative authority limited.This paper mainly divided into five parts. In chapter one, the introduction reviews the academic paper concerning the Provincial Assembly, and then discusses the issue of the research of this paper, and introduces the basis of the selected subject, material condition. The second chapter firstly introduces the establishment of the Jiangxi Provincial Assembly, it briefly introduces the writing backgrounds of this paper to the reader including the background of that time and senator situation, etc. Then it discusses the rules of the Jiangxi provincial assembly from the legislative perspective. It analyzed the legislative authority based on the rules made by Jiangxi provincial assembly. The paper then analyses the effect of the bill "removing the rules of tax", and discusses the nature of provincial assembly. In the third chapter, from this supervision, it analyzed the proposed drafts and implementation based on the nine bills concerning the administration in the two-year's regular meeting of Jiangxi's provincial assembly, and discussed the role of provincial assembly. The fourth chapter of the paper concentrates on the administrative part. Based on the discussion of executive effect of the bill, and of the relationship among governor-general, provincial governor, senator, and provincial assembly, it discusses the status of the provincial assembly. The last chapter is the conclusion. After conclude the exposition of whole paper, the author thinks that although Jiangxi provincial assembly can be defined as a local political setup with certain legislative power and superintendence which can discuss the affairs independently, it played a very limited role in the political life. In spite of this, as the inland province, the effect of the discussion of the bill of Jiangxi provincial assembly is not worse than the other province's. In the aspect of the democratic political construction, it launches the process of modern institutionalization of democracy of Jiangxi province at least.
