The Research Of Implementation Mechanism Of Comprehensive Nuclear-test-ban Treaty

Since the United States began the first atmospheric nuclear weapon test in 1945, nuclear testing has been the focus of international concern. Thousands of nuclear tests led to a more significant arms race, resulted out many new nuclear power states and brought serious damage to human health and global environment. The United Nations adopted the "Comprehensive Nuclear-Test-Ban Treaty" in 1996. The treaty is an important outcome of international law in control of nuclear arms and prevention of global nuclear proliferation. Most contents of the Treaty talk about the provisions of its implementation mechanism. The implementation mechanism is the key and the top priority of the Treaty,so it has both dual practical and theoretical significance of studying the implementation mechanism of the Comprehensive Test Ban Treaty.Through historical research, comparative studies and the law provisions in analysis, we could find that the implementation mechanism of the Treaty itself has a lot defects such as the scope of verification is too narrow, the capabilities of verification is lack, coercion and sanctions are weak, the executing agency has funds difficulties. There are many other problems such as the treaty is hard to entry into force and its exit mechanism isn't strict. These all affect the executing of implementation mechanism.To this situation, we should wide the scope which the implementation mechanism of the treaty determined, give a precise definition of"nuclear explosion", take full use of the civilian value of the implementation of the treaty, give the treaty the status of international jus cogens, punish parties who violate the treaty and ensure the funding of executing agencies. According to situation that the treaty is hard to entry into force, we can take provisional application. We also should strict the exit condition of the treaty. So it is a long way to achieve the comprehensive nuclear test ban and eliminate nuclear weapons.
