China's Rural Collective Construction Land Transfer System Is Perfect

With the accelerating industrialization and urbanization in China, during the process of urban expansion, industrial development and new rural construction, the growth of the demand of land requisition and circulation conflicts strictly land management increasingly. At present, in the collective practice and in regional economic development planning and land supply and demand situation, the collective and the governmental promotion has led to the 3rd Plenum of the 17th Communist Party of China Central Committee raise a resolusion that to modify the rural land management system in accordance with the principle of property clearity, use and in strictly control and conservation of intensive management. The reality is, the land transfer system of rural collective construction is far behind practice. China is in the process of accelerating development of urbanization, the urbanization inevitably requires plenty of land for construction as support, but the existing system of rural collective construction land circulation is an obstruction.This article through data collection and documents sorting and other methods, make clear the station of rural collective construction land circulation system, through analysis and study of the plight of rural collective construction land circulation to summarize the practical experience, using the related economics principle and the basic theory of marxism, and aiming at the limitation and the existing problems of circulation of rural collective construction land policy presently, and puts forward recommendations to inprove the rural collective construction land circulation system. Only the perfect system measures can cause the effective collective construction land transfer system, the efficient allocation of land resources, and while full playing to the land property value to promote sustainable use of land resource and the harmonious development of the rural society and economy.The article is divided into six chapters, main contents are as follows:The 1st chapter, the introduction section discusses writing background, significance, purpose, method of this paper, and make a review briefly from five aspects of this project contents related to the literature.The 2nd chapter, in this paper is to define the involve rural collective construction land circulation of the concept of this paper, and rationalize the basis of the theory of property rights and marxism paper analyzes landtax theory.The 3rd chapter, introduces the history and current situation of circulation of rural collective construction land.The 4th chapter, through main system analysis of collective construction land circulation in three regions—Wuhu of Anhui province, Foshan of Guangdong province, GaoLing of Shanxi province, to summarize the positive experience and expose the problems of rural collective construction land.The 5th chapter, collective land ownership virtual bits, object fuzzy, incomplete ownership power are analyzed from the perspective of property, and points out the institutional defects of rural collective construction land.The 6th chapter, put forward the path and system shield to perfect rural collective construction land transfer system from the pacts of rural collective construction land transfer system perfect principles and objectives.
