China is in a stage of rapid development of urban and rural integration,the construction of rural collective land investment needs a lot,and the more urgent is to straighten out the rural land property rights system,the release of rural social development,promote the healthy development of the social economy.The main problems affecting the circulation of rural collective construction land is rural collective land property right is not clear,lack of incentive and restraint mechanism,leading to the low efficiency of rural land resource allocation,damage to the interests of farmers,the urgent need to improve the relevant institutional mechanisms to solve the collective construction land management problems.Demand is bound to have the market,economic and social development is an urgent need for land transfer,making the concept of "small property room" and so on,highlighting the embarrassment of the existing system.The seventeen session of the CPC Central Committee,the third Plenary Session of the 18 th CPC Central Committee clearly put forward the reform direction to break the collective construction land transfer restrictions,the country started the pilot collective construction land in practice since 1999,and achieved good results,but the pilot with a strong government led color,government interest tendency is obvious,is difficult to really enter the market allocation of resources the lack of depth,the greater the number of spontaneous circulation of homestead pilot efforts.Through the study of the pilot work and the collective of a typical county construction land transfer case study,the author believes that the land transfer practice and exploration through collective construction,collective construction land value signal to be released,criticized the current system of growing concern,the management system of the policy reserves to be strengthened,for the collective construction land lay a solid foundation of policy and public opinion,the collective construction land circulation to represent the general trend.With the development of the real estate registration system,the reform of the household registration system and its supporting housing security system reform,the reform of the social security system,and laid a good foundation for the collective construction land transfer.The stage to solve the collective construction land transfer countermeasures: promote and relevant system reform,perfecting the collective ownership system,rationalize the land property rights,the full liberalization of collective construction land transfer restrictions,to achieve a decisive role in the market allocation of resources;the implementation of the collective construction land use system,solve due to historical reasons no longer meet the collective the conditions of use of land use,the protection of the collective interests of farmers;urban and rural housing property return to the basic security function mainly,as the principle of public resources to share equal to the real estate tax regulation as a means to establish compensation for the use of homestead and collective use coexist,city housing and land fluxion,the state and collective responsibility for urban and rural integration the basic housing security control system,the use of real estate registration system,the collective construction land Always under controlled condition;reasonably determine the positioning of government functions of management,strengthen the planning and control purposes,perfecting the property right incentive mechanism,giving collective autonomous management of collective land rights construction,perfecting the shareholding system,strengthen democratic management in rural areas,safeguarding the interests of farmers,improve the circulation system and other related supporting.
