Study On The Circulation Of Rural Collective Constructional Land

As the continuous advance of China’s modernization and urbanization， thedemand for constructional land increased sharply. However, due to the shortage ofland resources, it’s impossible to occupy agricultural land，especially arable land tosolve the question of urban constructional land．As a result，it’s urgent to put thecollective constructional land into market to circulate．However，the circulation ofcollective constructional land usufruct has been restricted by laws，regulations，policies， which resulting the disorder and spontaneous circulation of collectiveconstructional land largely existence and triggering a series of social problems, andnormal land order is under attack, furthermore,the national and collective interests areseriously damaged.At present, theorists haven’t given a reasonable explanation for the constructionalland problems in time, not to mention the forward-looking proposals,and the researchis obviously behind the practice. Therefore, to reform and improve the circulationsystem of rural collective constructional land, to break the urban-rural dual structureto and build a unified circulation system of land use right, it’s not only the urgentneed for rural economic development, but also the inevitable requirements ofdevelopment of the socialist market economy,at the same time, it is also the inevitablechoice to regulate the implicit circulation of land effectively.So the author studied thecirculation of the collective constructional land comprehensively in this paper,and theauthor hoped it will provide some reference to the normative development of thecirculation of the collective constructional land and the promotion of the reform of thecirculation system.This thesis includes the following components：firstly, it defined the relevantconcepts for rural collective constructional land and its circulation, it also describedthe theoretical basis related to the circulation of rural collective constructional landand introduced the provisions of existing laws about it. Secondly, combined with theactual situation of the current rural collective construction land, the paper analysizedthe current situation, the existing problems and the causes of invisible market of thecirculation of rural collective constructional land and its adverse impacts in ourcountry.Thirdly,the paper introduced the basic situation of rural collectiveconstruction land of the pilot in Wuhu, Chengdu, Chongqing, Guangdong and summarized the problems and experiences in pilot areas.Finally,referred to theadvanced experience of the circulation of rural collective constructional land fromhome and abroad, the paper re-examined the current land policy and system from anew perspective and put forward the ideas and policy proposals to improve thecirculation system of rural collective land for construction and then designed asupporting system for it, which provided thetheoretical directions and policyrecommendations jn developing land policies, improving the land systems and solvingproblems in the circulation of the rural collective constructional land for landmanagement department.
