With economic reform in our country, the contract labor relationship has become the subject of our labor relations. The harmony labor relationship is the basis of "harmony society" in China. But the wage level, working environment and social insurance of unemployment are far away from the expected level. The number of labor disputes is increasing year by year. The individual worker is not able to protect his own rights:the cost is too high to pay. The collective conflict in labor dispute happens from time to time, and it seriously harm the stability of society. As the organization of labor, when the labor disputes occur, the trade union often doesn't take any action or mishandle the situation. This paper describes the current situation of labor relationship in China and conclude that trade union can't take the responsibility it should and the government doesn't protect the benefit of labor force lead to this unbalance. Nowadays the universal situation is "labor is work and capital is strong". So the government should take the steps the balance the forces of capital and labor. The most important is to empower the labor the right to build their own organizations and the proper rights to negotiation. The goal of the government is to construct a collective bargaining mechanism.
