Strikes have become increasingly frequent in recent years and intense groups of laborconflicts has fully exposed the imbalance of China’s labor Game and the weakness of laborrights protection. Labor conflicts, has become one of the most striking contradiction in Chinesesociety. Building a harmonious society is an important prerequisite for social stability, and laborrelations issues related to social stability. Therefore, the consultation mechanism for theprotection of labor rights has major theoretical and practical significance for the establishmentof harmonious labor relations and promoting the building of a harmonious society.The current situation of the protection of labor rights in China is not optimistic, the mainreason is: the adjustment of labor relations in China has been guided by top-down model.Because it has neglected the consciously participation of labor coupled with the defects ofChina’s labor law system, the role played in the maintenance of labor rights is limited. At thesame time, as the nature of the pursuit of profit maximization, impaired labor rights cases occurfrequently. In the situation of intensified group conflict, this paper provides a bottom-upperspective, starting from the view of the labor itself, to seek a consultation mechanism tocoordinate the labor-management conflicts, so as to achieve the purpose of protection of laborrights.Based on the conception of cooperation in labor relations, this paper made a conclusionsthat workers can be obtained through the improvement of the trade unions and collectivebargaining system to reflect their own aspirations and safeguard their own rights. Therefore,this paper analyzes the initial practice and problems of the trade unions and collectivebargaining system in our country, then put forward the proposal to improve China’s tradeunions and collective bargaining system.
