Study Of China's Urban Housing Security Legal System

Over the past 20 years since reform and opening up, especially getting into 21st century over 10 years, the economy of our country developed at an unprecedented rate. With the rapid expansion of city scale, the excessive concentration of population and the price of houses in the city soar up without limit, the house problems of middle-low income class particularly become more and more significant. Along with the progressing of urban housing system reform, the market mechanism has already started to permeate to the housing realm in China.In urban areas, the continually rising house price makes many urban low-income families could not buy their own houses, a growing number of commercial houses as the castle in the air. Although there are many measures as low-cost housing, affordable housing, limit housing, housing provident fund, there is not a fundamental solution. And housing conditions of the poor has become a big problem , it seriously affects our normal economic stability and sustainable development.Currently, the world's major developed countries and regions are basically formed its own set of more comprehensive and effective legal framework for housing support, introduced and developed relevant law was put into the implementation. China's urban housing system is in its infancy, it is impossible to follow. There are the implementation of confusion and poor security situation. At the same time, housing security system involves the financial, administrative, legislative enforcement, judicial and legal system to support different aspects. It has not been improved. Therefore, China's urban housing security system, establishment and improvement of our country should be considered to learn the advanced system and measures from the West.This issue standing on the consumer point legislation analysis is divided into four parts:Part one discusses the basic contents and implementation result of our country current Housing Security system, meanwhile, effectiveness gradation, equality of the system have been pointed out.Part two analyses the basic characteristics of Housing Security System in developed country first. And then discusses the shortage of affordable housing, the lower rent house and price limited housing in the current system of China.The third section discusses gives the think-way to establish urban housing security, including establishing urban housing security system on the basis of the discussions of the aim and principle of copyright legislation, the control system of urban housing indicator and the supervisory and withdraw system.The last part presents new conception about the enactment of《The law of Housing Security》.
