Illegal Urban Governance Countermeasures

Urban construction has made great achievement and made a miracle in the history of urban construction in China since the reform and opening-up policy. But, simultaneously, it brings lot illegal construction problems that erode the urban resources, damage people's essential and long-term benefits and affect urban security seriously. Failing in resolving these problems will block the urban sustainable development and harm the socialistic justice and market system.My thesis starts with the cause and mechanism of illegal constructions, and use Pareto Improvement Principles, Maslow's Hierarchy Theory of Needs, Rojas'Humanistic theory, Weiner's Attribution Theory, and Public-participating and Harmonious-establishment theory to analyze the resource-wasting problems in illegal construction, violent-resisting problems and some issues of lack of long-effect system. Adopting different methods of Interview, Questionnaire, Comparative-research, Case-analysis, and Referring literature, this thesis analyzes the cause, administrative system and the angle of legal system synthetically, and then proposes logical resolvent. Settling illegal construction is the embodiment of vindicating the dignity of laws, safeguarding people's profit, advancing urban strength, realizing the thought of Three Represents, applying the Scientific Outlook on Development, and building a harmonious society.The present thesis is composed of five chapters. Chapter One begins with a brief introduction to the background and significance of the thesis. Chapter Two presents some problems in the management of illegal construction. Chapter Three is the actuality of illegal construction in Weifang city. Chapter Four proposes some strategies and suggestions of settling illegal construction for Weifang city. Chapter Five is the consideration for the management of illegal construction. The last part is conclusion.In the process of strategies and suggestions of settling illegal construction, my thesis sticks to the concept of people oriented, settling-scientifically, constructing economized-type and harmonized society as the instructing theory; proposes that settling illegal construction should start with the improvement of tipstaff and citizen's consciousness to different laws, build settling model of dredge-containment, strengthen citizen's surveillance, enhance the construction in communities, reform the system of examining and approving; and give strategies and suggestions from the aspect of executing the law, responsibility, consulting, satellitic monitor, reforming system and consummating legislation. In the aspect of responsibility assigning, not only the party, but construction branch, supervising branch, drawing-designed branch should be responded. In the aspect of consultation, all the branches should cooperate with each other to cut off the source of illegal construction. In the aspect of reforming and administration, my thesis follows the guidance of"unification, simplification, efficiency", goes with the time, innovates bravely, and changes the situation that urban management has no attributed branch, sets up unitive administration system or sets up urban management executing office. In the aspect of consummating legislation, my thesis appeals for promulgating a law of Urban Management, making rules to punish illegal construction and punishing to parties for illegal construction seriously. My thesis proposes that settling illegal construction should eliminate source-wasting and incarnate Pareto Improvement Principles, meanwhile, consider public benefit, long-term benefit, and parties'of illegal construction right and benefit. Under the situation of reducing damage for public benefit and parties'benefit, settling illegal construction will benefit all the people. Simultaneously, we should make good administration after dismantle the illegal construction, and insist on comprehensive settling and paying equal attention to construction-dismantling. My thesis also claims that urban management should incarnate the concept of people oriented, executing the law in science, civilization and harmony. The proposal and strategies in this thesis will play an important role in building scientific urban-administration system, consummating urban administrative laws, enhancing the efficiency of official administration. And my thesis will play an active instructing part in settling illegal construction for other cities, and make urban construction and management run a normalized and legal road.
