Bot Concession Government Behavior In The Operating Agreement For Oversight Of Research

BOT is a new form of investment which permit the private investor invetst the public infrastructure. This model has been adopted by our country in recent years. The emergence of such investment solves the problem between the lack of governmental financing and its due input in fundamental infrastructure construction, and promotes the process of Chinese public infrastructure-building. It's necessary for BOT project to transfer the concession.The government signs an agreement of concession with a private investor. The identity of government in the agreement is a private participator who participates in the market economic activities. It's very necessary to supervise the conduct of the government, because the government has a special identity and the agreement of concession is related to the public interest. In this paper, I break the previous research model that focus on the improvement of legislation. The basis of my paper is supervision of government's action. The premise of my paper is the government as a private participant who participates in the market economic activities. I want to research how to supervise government's action which in the concession agreement. In this paper, I use the standardized research methods and empirical research methods. Through the study of this article, I not only hope to perfect the monitoring mechanism of government's action, but also hope my research in this article advance theoretical study of supervision government's action that as a private participant in a market economic activities.This paper is divided into three parts. The first part is the need for supervision of government's action in BOT concession agreement. I discussed my main theory in this part. At the same time I discussed the nature of concession agreement. I think it is a special civil contract. The identity of the government is a private participant who participates in the market economic activities. The second part is the reality of supervision of government action in the agreement. I pointed out the problem of supervision system of government action from the practice point of view. The third part I want to build the mechanism of supervising government's action and make some superficial suggestion.
