On the background of the historical review on the relationship between the American President and the Supreme Court, the thesis enunciates the whole process of the conflict between President Franklin D. Roosevelt and the Supreme Court in 1930s. With the analysis of the influence of this conflict on the relationship of modern Executive and the Judicial Branch, it helps to demonstrate the characteristics and the discipline of the American political system on the basis of the Constitution.The forward introduces the motivation that the author selects this topic to discuss; the methodology that the article is based on; and the how the related study has been developed in the domestic and foreign academy.The thesis can be divided into three parts. First, it traces back the moderate tensions or tense conflicts between the President and the Supreme Court and changes of the number of the Court members in American history before 1930s. Secondly, it demonstrates the conflicts between President Roosevelt and the Supreme Court in details. The conflict ends in the failure of "the court-packing plan" conceived by the President and the "timely switch" of the Court. Several reasons lead to the result: the philosophy held by the Court members, the unconstitutional process of the delivery of "the court-packing plan", the will and the reaction of the public and the political position of the Congress. Thirdly, it analyzes the reasons of the failure of "the court-pacing plan", however, it is the President who wins, and sets forth the historical influence of the conflict.After 1930s, the historic turning point of the development of both the Executive and the Judicial, the power of the modern president is greatly expanded, and the Court plays a more and more important role as a supervisor in social affairs as well. It aims to offer a clear instruction of the development of the Supreme Court, and to reveal how the stability ofchecks and balance is kept in the development and conflicts between the President and the Supreme Court.
