Justice, Good,

"Fairness and Justice" appeared multiple times on the Premier Wen's work report on this year. From this we can see that the social fair problem has caused more and more attentions in our country nowadays, from "Efficiency First Pay Attention to Fairness" to "Pay More Attention to Fairness", we can feel that the working method of our government is changing, the problem of the justice of social distribution is becoming more concerned. The social justice is a necessary requirement for us to construct a harmony sociality, the sociality can be harmony and steady only if there is fairness and justice in the whole sociality, thereby how to accomplish the social justice will be an eternal topic for all sociality full of dreams and achievements.As the system innovating, the social system is also become perfected with it, however it did not reduce the injustice phenomenon in the sociality, on the weak people's side the procedures and systems did not give them more insurance for their rights, but make them feel much less humanity, thus we have to ask why it has bring us immorality by obey the procedures? Is the injustice of procedures and systems themselves? They can not be generalized like this! Is there any other issues needed to be considered (moral problem of good) behind the reasonable carried out of procedure? The procedure justice is necessary it is an un detachable part to insure the justice, however this kind of insurance is not prefect but flawed, it needs the essential justice to make up for it. On this method, this paper is going to discuss the moral reflection problem of procedure justice.The moral reflection of Procedure Justice is the reflection to the justice and good in the Procedure, while the first to be confirmed is the necessity of the Procedure Justice, however, with the over emphasized to the Procedure Justice in the modern society, we also found that we are putting the duty and obligation into opposite positions while emphasizing the procedure, Procedure Justice cannot well reflex Substantial Justice but even deviate from it. What caused this deviation? This paper is going to start with thebasic problem-----the relation between justice and good, analysis the inner connectionbetween them, emphasize that justice is the base of 'good', at the same time 'good' also holds an important figure injustice. Then how to understand the theories of good? First we should distinguish the 'strong' theory and 'weak' theory of good, we can put the 'good' in Substantial Justice to weak theory and 'good' in Procedure Justice to 'strong' theory, at last I should find the pass to justice by analysis the traits and differences between 'good' in Procedure Justice and Substantial Justice。The design of procedure and the perfection of system need not only a criterion based on a set of justice principles to give reasons and legal rights to itself, more importantly the object is how to reflect the idea of "Good" in the principles, how to combine justice and good. The stable of sociality and the citizens' happiness have to based on the principles of good of justice, in modern human society, 'Good of Justice' should be consider dynamically being developed and on the way of evolution, it should not be consider statically as an aim of extreme good or ultimate object of human. On the one hand, we have to use "the status should be" to guide "the status at present" to put the spirit of Utopia into the political design of human, on the other hand we have to turn the external restriction into internal sublimation base on the framework of social system with the affection of social education.The design of procedure is the inner requirement of the operation of human sociality. Any set of procedure is based on the dominate ethic value system of the sociality. Ethic should be the origin of procedures' criterion. It shall be the culture rather than the citizen to hold the burden of the loss of good of justice in the design of procedures, it should be carried by the culture and responsible by system in the middle.
