Agency theory is an economic theory with the development of information economics. Its analyzing method has been widely applied by other social sciences, especially by political scientists who use it to analyze domestic political system of the United States. The core concerns of Agency theory are how to design and build a relatively complete contract and control mechanism for the agents when their interests are not consistent with each other under the circumstance of information asymmetry, which was essential to promote the interests of the principal. The theory has been widely introduced into the study of international organizations, and this thesis is the practical application and test of the theory. Based on the agency theory in economics, political science, international relations research, the thesis systematically explain Agency theory in international organization delegation.The thesis combined with the negotiation and founding of the International Criminal Court to explore the benefits of delegation to international organization, how to design effective control mechanism for international organization agent, and the permeability of international organization agent. In the process of delegation, especially in the process of international organizations creation, third parties will play a very important role as information providers. Finally I concluded that the establishment of the International Criminal Court is expected to meet the Agency theory. Agency theory can be applied to the analysis of many international organization delegation.
