Establish The Law Of Household Appliances Defective Products Recall System

Rapid development of technology gives an impetus to replacement of household electric appliances. In order to be more competitiveness in market, enterprises are trying to fasten development of new products and production so as to be as strongest in market. Hence the possibilities of defect household appliances are constantly rising.This thesis makes theoretical analysis on defect product recall system; discuss practical status of China in regime of recalling defect household electric appliances and puts forward some suggestions based on above statements.The thesis has 4 chapters including preface. Author introduces the function of recall system in economics and status in China in preface and then in the first Chapter looked back the historical background of recall legal system and critical principles, analyzing its ultimate purpose of protecting consumers and legal conception of society interests standard. Author also differentiates related concepts under recalling system. It is introduced in the second Chapter practical background and legislation in China and suggestions are proposed regarding improving legislation. Author tried to draw a whole picture for various countries with developed recall system in the 3rd Chapter and then analyze recall system of household electric appliance from substantial and procedural angel in different countries. Author hopes these comparisons can be of reference for China. Author talks in length in 4th Chapter about recalling system of household electric appliances in China and proposes suggestions on legislation; related legal system. Author firstly analyzes the industry and possible relief consumer can seek and then bring forward the urgency of establishing and improving recalling system for household electric appliance. Author goes through the drafted recalling regulation and put forward some areas where needs to be further clarified and also necessity of constructing related systems including class action system; product information collection and retrieval system and product recall insurance system.
