Housing is essential basic subsistence that people needs. Housing a major socio-economic problems.The quality of housing issue has a direct relationship about a country's stability and economic development.In order to regulate the current national real estate market,the country issued a series of laws and regulations and introduced a number of policies.Policy refers to the state or political parties identified the action guidelines and criteria in order to achieve certain political, economic, cultural objectivesand tasks.Through the development of policies to determine the action's purpose, principles and measures.Law is decided by certain material living conditions, made and approved by the state or by state.at the same time,the law is universal effective code of conduct system,which is implemented by coercive power.the purpose of law is to maintain, consolidate and develop certain social relations and social order.Policy Mainly guide the real estate marke from the macro,however, the lawis from the specific protection.the relationship between policy and law now has been well defined in theory.But policies and laws which countries have been enaced to regulated the real estate market that has played some role though, but the effect is not obvious.In recent years, housing prices rose too fast,in order to control the real estate market, the state introduced many policies, mainly related to finance, land and taxation.While increasing the intensity of state regulation, but the higher price is still more stressed.These shows the state in dealing with the issue of the direction of the real estate has some problems.Currently the real estate markets have a lot of market size, In recent years, housing prices rose too fast,in order to control the real estate market, the state introduced many policies, mainly related to finance, land and taxation.While increasing the intensity of state regulation, but the higher price is still more stressed.These shows the state in dealing with the issue of the direction of the real estate has some problems.Currently the real estate markets have a lot of market size, The state Frequently rely on the introduction of national policies to control the real estate market,whichis not enough.The paper start from the relationship between policy and law, then list policies.now the Countries rely on the macro policies introduced that can not meet the needs of market.From the specific content of the policy, the paper pointed out policy exists an unreasonable and unlawful places.So the government should rely on legal means, rather than relying on economic means to improve the current state of real estate,as well as it should speed up the pace of the legal system as soon as possible.At the same time,As the real estate relating to the stability of our economy, the state intervention is essential, but should be appropriate,and countryshould follow certain principles when introduces policy.The paper will explore the current real estate policy from the legal point of view.Firstly,this paper introduces the concept of policy and law, then the distinction and relation between the two. Secondly, the analysis of the current real estate policies, mainly on real estate policy since 2003, and then as pointed out problems in the real estate policy.Finally, putting forward some sound advice to these problems from the policy, legal point of view.
