People On Behalf Of The Powers Of Supervision And Restriction System Of The General Assembly

The system of people's congress is the fundamental political system of China. Strengthening the role of supervision and restriction to the power is the basic requirement of it's own quality. The National People's Congress is supreme organ of state power, which is on behalf of the will and interests of nationalities of the whole nation, and transforms them into a national will. Strengthening the role of supervision and restriction to the power is an important item of modern democracy. National people's congress, as well as the standing committee of it is also the requirement of political democratization and legal perfectionism of China. Since our reform and opening-up, the National people's congress, as well as the standing committee of it, has made much progress in legislation, which has resolved the problems of being short of law. However, it is still deficient in our supervision and restriction to the power, and aspects of failure to observe the law, no strictness in enforcing the law, refraining from punishing law-breakers are very common. The main method to solve these problems is through strengthening supervision and restriction from the people's congress. Only in this way, the authority and dignity of state legislation can be protected, and building a socialist country under the rule of law can be propelled.The whole paper is divided into 3 chapters. Chapter 1 give a brief introduction of some representative ideologies on supervision and restriction of power from western countries and China. The subsequent description is based on it. The ideology on this point was first developed by bourgeois ideologists. Locke, Montesquieu, Jefferson, and Dahl were representatives among them. In China, Sun Yat-sen, Mao Zedong, and Deng Xiaoping played great roles in Chinese history, whose demonstration on this point will direct the political practice of China. Chapter 2 concentrates on analyzing the present condition of our supervision and restriction of power. While I sum up what we have achieved on this aspect in past few years, I also summarize our disadvantages. Following the approach of putting forward and then solving the problems, I provide some solutions in Chapter 3 on those problems. This is also the main part of the whole passage. First of all, based on the present the status quo of China, we should untangle the relationship between the People's congress and Communist party which is the base of building up the country under the rule of law and political civilization. To accomplish this task, the people's congress should be improve itself, which assure to achieve it's goal. Specifically, the main point of such role of the people's congress concentrates on supervising and restricting governments, courts, and procuratorates. Among those institutions, it's supervision of government is the most important, due to the nature of administration, as well as the present condition of China; on the supervision of jurisdiction, the key is to propel the judicial justice, and protect it from corruption.
