The Role Of Lawyers In The Legal Construction Of China

Since the founding of the People's Republic of China, especially over 30 years of rapid progress in reform and opening up, the awareness of the rule of law has been gradually strenghtened in all sectors of society. The theory of rule of law has been continuously enriched and developed in practice. The legal system construction of China has achieved festivity achievement. A lawyer, as a legal professional of socialist has made outstanding contributions in various fields such as legislation,law enforcement, justice, etc.This paper, starting a discussion with the topic of "The Function of Lawyers in The Constructions of The Rule of Law in Our Country", is having positive analysis of one hundred Beijing lawyer samples. The purpose of analysis is to enhance the research on the role of lawyers in construction of rule of law in our country. Deepening relevant theoretical understanding, ensuring the contribution by lawyers, promoting the integrated development of legal system.This paper divides into three parts. The first part is regard to the development of lawyer system in New China and the history of legal system building. The second part is about the analysis of the range of legal system building, and also the relation between lawyers'legal function and lawyers'other function. Based on material of survey, the third section analyses the forms and features of lawyers'function. Combining the material, the fourth part is the reflection of lawyers'difficulty and challenge in legal system building, and the suggestion of full function of lawyers in legal system building through our country.The main innovations of this paper can be found in these aspects:(a)the analysis of lawyers'manifestation through lawyer's career , legislation , law enforcement , justice work and other areas ,and also the presentation of lawyers'general function in every fields, based on the data analysis of survey.(b)According to the survey, with analysing the data of legal function between legislation,law enforcement, justice work and other areas, the conclusion finally is found that lawyers'roles are limited in the area of legislation and law enforcement.(c)Based on the demonstration, the author states the difficulty and challenge confronting by lawyers in our country and make a proposal in the promotion of socialistic process of legislation through relevant system, social and cultural perceptions and lawyers themselves.
