On The Function Of Lawyer In The Rule Of Law

The Bar is a profession which provides various subjects with all-round law service. Its functions are of great significance which can confirm the existence value of the Bar in the course of the development for the men-ruled society to the law-ruled society. In the law-ruled society, its functions include protecting rights, promoting economic benefits, keeping social stability, assisting administration, and advancing culture, all of which are based on the establishment of modern market-oriented economy, the development of democracy, the building up of law conviction and the indepence of the Bar. Nevertheless, presently, the Bar's functions in China are not fully carried out because of some restricting conditions in such aspects as the lawyer's competence and their own rights, the judge's competence and judicial indepence, and the administration according to the law. This thesis puts forword some views which will contribute to carrying out the Bar's functions for discussion on practice permission system, administration system of the Bar, lawyers' legal operation and specialization, and judiciary indepence.
