On The Subject Of Rights, The Right To Compulsory Education

As one kind of basic human rights, right to compulsory education is the premise of survival, healthy growth and free social participation after dependence for every school-age children and adolescents. However, in China, the laws and regulations about the subject of right to compulsory education are not very perfect and the safeguarding mechanism of compulsory education doesn't sound very well. Because the subject of right to compulsory education lacks of normative legislation, in the process of practicing the right to compulsory education, the subject of right to compulsory education encounters many obstacles, which eventually led to the right to compulsory education unable to get the legal and effective safeguard.Meanwhile, as an important content of compulsory education and theoretical foundation of compulsory education legislation ,the academic circle in China does not highly attach importance to the subject of right to compulsory education and lacks of comprehensive and in-depth study for it. Therefore, there is not a unified standard to apply the law in practice, which causes the great difficulties for law enforcement and social problem resolution. So, the study of the subject of right to compulsory education has great theory and practical value.The author in this article will have a deep analysis and discussion on the basic theory of the subject of right to compulsory education, and research problems and reasons existing in our country's legislation systematically. Meanwhile, the author will take examples from the good foreign experience and compare them with actual situations in China in order to provide some legislative suggestions about how to perfect the law system relating to the subject of right to compulsory education. I hope the right to compulsory education can get legislation effectively guarantee and try to put forward some opinion about the legal system of the compulsory education.
