Citizenship can be defined as a sum of rights,obligations and responsibilities in thecommunity public life of an individual as a member of the community,which areexisting together under the guide of community rules in a state of dynamic equilibrium,and they constitute the core of a rational modern citizens’ basic qualities.Some contentsof the Chinese traditional culture is out of the demand of the democratic process and therule of law process,and some laws and institutions do not adapt to the place.Theyrestrict the foundation of the Chinese construction of modern democracy and the rule oflaw,and cause some damages to the achievements of the Reform and Opening.Theconstruction of citizenship is the only way to achieve democracy and rule of law inChina.In this paper,citizenship is a starting point,we hope to solve the real problemsaccordingly through fostering the citizenship,through the constraining of the rights,obligations,and responsibilities,and gradually lead the citizens to take part in socialpractice actively,and thus establish a more equal citizenship status,establish a morescientific system of citizenship law,so as to protect the human rights and promote thesociety ruled of law.This paper is divided into four parts: The first part focuses on the concept of "citizenship" and the related knowledge,and the paper define it as "the membership ofthe Country Community",and defined it as a legal category culture,and then through abrief description of the legal application of "citizenship",make it clear to the readerswhen understanding the cultural patterns.The second part start from the social concern,we choose the real problems whichmust be faced in the construction of citizenship,and make a more detailed discussion,inorder to lead the reader face the attitudes,laws and institutions which are out of thedemand of "citizenship" and clearly understand the dangers they made to human rights.The third part is the respond to the real problems,and it tries to solve the problemswhich do harm to "citizenship" in Chinese social by three aspects of means such asfostering the concept,developing the legislation,and adjusting the social institutions,andthen provide a reference for promoting the reform of the social system and the rule oflaw,promoting the improvement of modern democracy and rule of law,and protectingthe human rights.The fourth part is a summary of the paper.It makes a response to the constructionof Chinese democracy and rule of law,that is to promote the construction of citizenship,and China should face the world’s process of democracy and rule of law with an openmind,and in particular,react to the shock of "global citizenship" to Chinese societyactively,thus promoting the development of Chinese process of democracy and the ruleof law.
