And in recent years, it makes more difficult to prevent and punish duty crime because of its groupment, diversification and internationalization. So on the exercise of power control is necessary. There is no specific law about prevention of duty crime in China so far. At percent, crime prevention duties in China is mostly reflected in the regulations, local regulations, this directly leads the prevention of duty crime do not have powerful support and it can not become a national strong duty crime prevention system.The direct reason of prevention of duty crime is that power alienation. The defect in the balance of power, power supervision system and the operation of power makes power unlimited expansion and operation of power off track, becoming a tool of making profits for person or small group. The correct power value is a precondition for exercising the power and another necessary condition for exercising power is scientific allocation of power. The exercise of power should be in the open and transparent environment, to realize the full range of power operation and the extinguish of duty crime under public environment. Based on this, the main ways of power control of prevention of duty crime are as follows: optimize the power balance mechanism; improve the power supervision mechanism; standardize power operation.
