Research On Environmental Justice Guarantee In Yunnan Province

The twin of the economic development is the increasingly worsened ecological environment. Various occurrences of pollution events severely devastate the ecological environment on which the human existence relies and threaten the healthy development of human beings. The opening of the Fourth Plenary Session of the Eighteenth Central Committee shows that the nation has realized the important of protecting the environment by the requirement on formulating a series of environment-protecting laws and regulations which are stricter in terms of environmental protection. Environmental legislation is the final guarantee to maintaining the legal system of the ecology and environment, solving ecological and environmental disputes and protecting the ecological and environmental justice. Marked by the establishment of environmental courts in Guiyang, Wuxi and Kunming, etc, the judiciary authority has walked out of the once passive status and applied positive environmental protection-related judicial reform to address the environmental crisis. The establishment of the environmental courts is an innovation to the environmental protection system. The new environmental protection law enacted in January 1,2015 has brought a new dawn to perfect the judicial guarantee for the environment.By sorting out typical domestic and foreign experience in the researches on environmental legislation, combining the survey on the current status of Yunnan Province in judicial environmental protection, this paper proposes its own ideas on how to improve judicial environmental protection in Yunnan Province. This paper is divided into four sections. The first section is an overview of the judicial protection to the environment, and expounds the concept, value, environmental judicial safeguard relevant theories and the necessity of judicial "safeguard the environment in Yunnan Province. The second section describes the current status of Yunnan Province in judicial environmental protection, simply introduces the environmental protection and current environmental status in Yunnan Province, to analyse the typical cases of judicial safeguard environment in Yunnan Province. The third gives an analysis on existing issues in judicial environmental protection in Yunnan Province. The fourth section proposes some improvement strategies accordingly.
