Research On Optimizing The Business Environment Of Rule Of Law For Hvdropower Proiect Construction In Yunnan Province

Yunnan Province is rich in hydroelectric resources1.As a target industry for the province to cultivate pillar industries,the hydropower industry has provided strong clean energy support to the country.In the context of the new normal economic development,this industry is also facing the pressure to become better and stronger.With the advancement of the country’s work to optimize the business environment,some problems of business operations of enterprises have been resolved.To further exert the effectiveness of the work of optimizing the business environment,we need to explore ways to address the development of target industries.Hydropower projects have the characteristics of technical speciality and legal regulation,therefore,the civil and administrative legal relationship involved in the project is complex,and the development of the industry needs the support of the "rule of law".Judging from the regulatory framework of economic law,the hydropower industry involves the relationship between market subjects and market order regulation,macro-control and social distribution.To promote the development of the hydropower industry,it is necessary to analyze the legalization needs of the business environment of the industry,adjusting the structure,organization,and regional coordination of the hydropower industry with economic law methods of market regulation and macro regulation,and provide targeted legal business environment protection for the development of the industry.The first part of this article starts with the need for the country to coordinate economic relations,analyzes definition of government policies and the elements of the business environment governed by law,and the business environment framework of the rule of law required for the construction of hydropower projects.It mainly involves actors’ rights and responsibilities in several aspects: the allocation of regulatory authority at the government level and the level of enforcement,the regulation of laws,regulations and policy systems,judicial filing and enforcement.The second part based on the economic law relationship involved in the construction of hydropower projects,collects the development status of hydropower projects in Yunnan Province and representative projects and enterprises through analysis of the industrial chain;through the inspection of individual hydropower projects,analyzes the project approval and land acquisition compensation in the construction of the project,and specific problems in labor market supervision.The third part proposes targeted solutions for optimizing the business environment of the rule of law for the construction.Starting from the government’s macro regulation and control,standardizing market management,and judicial service guarantee construction,it is suggested that the government should establish a regional coordination mechanism across provinces and regions.Scientifically carry out regional planning for large-scale projects,optimize the1 engineering supervision system,and strengthen labor market supervision;enterprises should promote the legal operation under the guidance of project construction;the judicial side should actively play court functions and improve diversified dispute resolution mechanisms provide cross-regional judicial service guarantees.
