30 years of reform and opening up, China’s economic and social development has made remarkable achievements. Especially after 2001 China joined WTO, the market economy is to obtain an unprecedented rapid development, became the world’s second largest economy, attracting a large number of foreigners come to China to seek employment and development. With the increasing number of foreigners employed in China, the number of illegal employment is also rising rapidly, especially teachers, Filipino illegal employment of a very serious problem. In Shanghai, for example, according to statistics, from 2003 to 2005, employment in illegal Shanghai Exit-Entry Administration of Public Security found were 115 people,110 people and 71 people, from 2007 to 2009, Shanghai Public Security Exit-Entry Administration found illegal employment were 363 people,371 people and 350 people. These illegal employment of foreigners in China has seriously affected the normal entry and exit of order, the impact of China’s low-end labor market, and even endanger the national security and stability.So the study, improve the management system of the employment of foreigners in China, illegal employment of foreigners in China, legal regulation, are of great significance in theory and practice. In this context, the author of Shanghai General alien employment administration cases, combined with their own practice in immigration work, Marxist dialectical thinking as a guide, using historical analysis, comparative analysis, inductive analysis, systematic analysis the employment of foreigners in Shanghai general management situation, pointed out that the legal system of the employment of foreigners in management problems and learn from the advanced experience and practice abroad, put forward countermeasures to improve the management of general employment of foreigners aspects of legal regulations, in order to solve the country foreigners sleepy employment management.This paper is divided into four chapters. The first chapter introduces the basic situation of illegal employment of foreigners in China, including the concept associated with illegal employment, illegal employment of foreigners in China Cause analysis, type, features and realistic hazards. The second chapter describes China’s relevant laws and regulations, especially the provisions of the new immigration law in the management of the employment of foreigners and problems. The third chapter introduces the experiences and practices in the EU and the United States and other developed countries, the management of the employment of foreigners, to our country in order to learn. The fourth chapter is to improve the management proposal for the employment of foreigners in China areas, from five aspects of the measures provided for reference to the legal regulation of employment of foreigners in China management.
