The Research On The Illegal Aspects Of Unlawful Employment

With the increasing number of foreigners coming to China,the pressure on the illegal employment of foreigners is increasing.With the increasing legal awareness of foreigners,the relevant legal disputes are gradually increasing.The identification of illegal employment requires some theoretical research to support And to guide practical work.In this paper,through the discussion of the law and the judicial case,the author tries to come back to the illegal employment investigation system design purpose,which is to maintain China's labor management and exit and entry administration,to analysis the illegal aspects of unlawful employment,which contains such situations: the behavior should not have Chinese nationality;employment behavior should also meet the conditions of exchange of economic interests,and to replace the existing labor force in China;work-study and other types of employment should also meet the relevant regulatory requirements and to fulfill the relevant procedures;for foreigner who has got the employment license,his actual employment place should match the license.Through the research on the relevant elements of unlawful employment,tries to provide some legal support for the practice.
