Research On The Court Of Supreme People 's Court

The fourth plenary session of the 18 th Communist Party of China(CPC) Central Committee announced The Supreme People’s Court will set up Circuit Courts, and the country will explore establishing cross-administrative region courts and procuratorates. The exploration of the Circuit Court is a key step in of the judicial reform and its failure or success is a life-and-death matter to the overall judicial reform process. It is necessary to drill down to the advantages and disadvantages of the Circuit Court, and put forward improvement methods.Firstly, this paper discusses the Circuit Court system at all time and in all lands, analyzing the process of evolution of Circuit Court system in China and British and US. This paper focuses on the comparison of Circuit Court system in different times and different countries.The second part discusses the function of the Circuit Court of the Supreme People’s Court of china, which is rejecting the interference of local government, easing the petition pressure in Beijing area, alleviate the work stress of the Supreme People’s Court of china, convenient for litigation. We are trying to find out whether the Circuit Court has reached the objective of establishing or not.The third part discusses the establishment of legal basis, the resistance to local government interference, humanity care of the personnel arrangements of the Circuit Court. It was found that three problems need to be solved urgently, which is the deficiency of legal basis, the limited ability to resist the local government interference, and the humanity of personnel arrangements needed to be improved.Finally, on the basis of the discuss of the establishment of legal basis, the resistance to local government interference, and the humanity care of the personnel arrangements of the Circuit Court, this paper suggests that we should strengthen legislation, allowing "leapfrog" appeal, and improve human caring of the judicial officers. The author hopes to advance the development of the Circuit Court of the Supreme People’s Court of china.
