China 's Public Participation In Legislation

Public participation in legislation is a part of the political participation of citizens. It is one of the important ways for people to exercise their power and administration of state affairs. Public participation in legislation is the objective requirements for improving quality of legislation. Public participation in legislation in China developed slowly,for a long period of time. Public participation in legislation in China is developed considerably,In recent years. Nowadays participatory approach legislation becomes more and more diverse. However, it still lacks a complete system and full implementation. In this paper, we analyzed the basic theory of public participation in legislation, confirmed the strategic importance and value.We examined China’s current situation and a number of international models of public participation in legislation, and provided ideas for promoting our public participation in legislation orderly.This paper is divided into four parts, in addition to the introduction and conclusion,each part of the contents are summarized as follows:The first part, a general overview of public participation in legislation.This section defines the relevant concepts and analyze the strategic significance and strategic value of public participation in legislation. By the definition of related concepts, this article is to explore the clearly body, purpose, manner of public participation in legislation. It includes the Marxist theory of the state and related theories, origins of Western theories of public participation in the legislative, such as the theory of popular sovereignty, the theory of participatory democracy,the theory of deliberative democracy. Public participation in legislation is conducive to promoting the development of socialist democracy. It is conducive to promoting the rule of law in society.The second part, This section analyzed the situation and reason of public participation.We investigated historical process of China’s public participation in legislation and its institutionalization, summarized its trace and development process. From material above, we summarized the learned lessons, found the problem, and provided the possible improving direction.The third part, the investigation of practice and institutional building of public participation in legislation.This section, we investigate the foreign relatively sound practice and institutionalized of public participation in legislation. We can get inspiration from this experience.The forth part, advice for orderly promoting public participation in legislation in China.In this part, we make our advice from the factors of system and participants. Public participation in legislation needs corresponding support system. Therefore, system and supporting system for public participation in legislation should be built. Civic education, especially the constitutional education part, should be strengthened. Legal knowledge should be more promoted and educated. Civic is the main part of public participation in legislation. The sense of participation is the ideological foundation of public participation in legislation.From legislative perspective, we think that legislature should establish the concept of people-oriented legislation, and create the environment, such as a network platform, to promote public participation in legislation.
