A Study On The Construction Of People 's Mediation Organization In Yangzhou City

In recent years, China has made remarkable achievements in economic development, its Gross National Product (GNP) ranking No.2 in the world. However, with the rapid development of the economy, social problems increase sharply and social conflicts emerge in large numbers. Faced with new domestic situations, in order to effectively solve social conflicts and maintain fairness and justice, our social governance mechanism must be reformed and innovated. The distinctive Chinese system of People’s Mediation caters to the national psyche of the Chinese people and the practical needs of the country’s social development. People’s Mediation is an important measure to resolve disputes through non-lawsuit approaches. Currently, it has become an effective legal system, and kept on making progress and perfections. It has much significance in terms of solving social problems with high efficiency while at relatively low social costs. However, People’s Mediation has not achieved its full potential, since its capacity of resolving social conflicts could be seen gradually declining. Besides the influence of the social environment and relevant policy-making, the system’s role has been compromised by the underdevelopment of People’s Mediation organizations. This paper starts from the point of view that People’s Mediation mechanism is an important component of the Chinese social governance system. It analyzes the major problems concerning the construction of People’s Mediation organizations in Yangzhou city on both theoretical and practical levels. Firstly, it narrates the relevant concepts like People’s Mediation and the People’s Mediation organizations, and introduces the organizational form and working principle of People’s Mediation, thus laying the theoretical basis for the research in the paper. Secondly, it analyzes the current operating situations of People’s Mediation organizations in Yangzhou city, and demonstrates the necessity of the standard construction of these organizations. The author discovers the problems of People’s Mediation organizations in the following five aspects, i.e. the working mechanism is not perfect, the fund guarantee insufficient, the lack of standard management, the capabilities of the people’s insufficient, and the lack of participation of legal professionals. In addition, corresponding countermeasures and suggestions are proposed for addressing these problems.
