A Study On The Status Quo Of Mediation In Community Governance

The people’s mediation system, known as’ the Flowers of Orient’, has been followed since ancient times and becomes the effective way to solve disputes in our country. Community mediation is an important part of people’s mediation, with its voluntary, flexibility, civil, which makes it becomes appeal to people to solve disputes in the folk. With the collapse of the unit of society, the establishment of the society of strangers, interpersonal relationship has become increasing sophisticated, the community mediation becomes a kind of effective way of non-litigation dispute resolution. What’s more, community mediation plays a significant role in prompting the community governance, solving society contradictions and maintaining stability in our modern country, and it’s an indispensable complementary of the civil litigation system and can effectively reduce the pressure of litigation. Therefore, the research on the community mediation mechanism has the profound theoretical significance and practical significance.This article is from the concepts and related principles of the community and community mediation, viewing the theory of civil society, the third field of society, the third department theory and the theory of limited government as the foundation for theoretical research. Besides, the paper is aimed at revealing the deep reasons that our Chinese people, in the traditional and modern community, choose community mediation preferentially when dealing with disputes, in the sight of traditional culture, politics, society and the parties’ subjective intention and objective perspective in the modern society. Thirdly, the paper got the data information through the interviews, case analysis and practical investigation and then studies the shortcomings of community mediation based on the survey of Qixia Distrtict. Finally, based on the above theories and empirical analysis, the paper puts forward the suggestions to improve the present situation of community mediation in our country, including the constructions of community mediation system, team building and promotions.
