Research On The Legal System Of Inland Waterway Transportation Regulation

The comprehensive transportation system of China consists of five modes oftransportation: air transportation, railway transportation, water transportation, roadtransportation, and pipeline transportation. Water transportation can be divided into marinetransportation and inland waterway transportation. However, affected by ideas of “inlandtransportation is more important than waterway transportation” and “inshore is moreimportant than inland waterway”, inland waterway transportation has not been given enoughattention. In recent years, as China has been committed to building a resource-saving andenvironment-friendly society, advantages of inland waterway transportation like big capacity,less cover, small energy consumption, light pollution and other advantages will gradually beused. Problems come with progress as our inland waterway transportation develops rapidly.The development and improvement of the regulatory legal system of inland waterwaytransportation fall far behind the development of economic construction. Meanwhile, inlandwaterway transportation of regulatory legal system in European and American developedcountries is almost completed and developing toward a stable, efficient and environmentfriendly stage.First, this thesis makes an overview on the basic theory of inland waterwaytransportation regulation, mainly including the definition of specific concepts, analysis ofcharacteristics and principal function of inland waterway transportation regulation. On atheoretical basis, in order to make deep analysis, the author divides inland waterwaytransportation regulatory legal system into four parts: inland waterway transportation safetyregulatory legal system, inland waterway pollution prevention regulatory legal system, inlandwaterway ports regulatory legal system and inland waterways regulatory legal system. Mainlaws, regulations and policies of the four legal systems are settled on a time line. Second,valid experience for improvement of China inland waterway transportation regulatory legalsystem is provided through illustration of main content of inland waterway regulatory legalsystem in the United States and European countries. Third, the author analyzes shortcomingsof the four legal systems one by one, and proposes suggestions for improvement. Finally,advice for improvement on legal and institutional level is put forward based oncomprehensive analysis of regulatory legal system of inland waterway transportation.
