Shanghai Yangtze Estuary Research - The Management System Of Chinese Sturgeon Nature Reserve Legislation

Yangtze River Estuary Chinese Sturgeon Nature Reserve, established by the Shanghai Municipal People’s Government in July2003, is a Provincial Nature Reserve. Since then, it has been playing a huge role in protecting Chinese Sturgeon, the First-Grade State Protection animal in china, and the natural environment of Yangtze river estuary in which it habitats. In2008, Yangtze River estuary sturgeon Nature Reserve is included in the International Directory of Important Wetlands. Meanwhile some problems exposed since the implementation of the "management approach". Local laws and legislation of Yangtze River Estuary Chinese Sturgeon Nature Reserve is included in the legislative plan of the Municipal People’s Congress In2009. Before the introduction of the new ordinance, a detailed study of the Nature Reserve legislation has a profound practical significance. I only do some further research on one of the management system due to the limitations of my time and effort. An overview of the Yangtze River Estuary Chinese Sturgeon Nature Reserve and the legislative status quo tell us that Shanghai Municipal Agricultural Commission in conjunction with the Chongming county government is the administrative organs of the Nature Reserve. The Management Office of Shanghai Yangtze River Estuary Chinese Sturgeon Nature Reserve is the governing body of its daily business, and the Shanghai Environmental Protection Bureau is the supervision and guiding body. The Shanghai agriculture commission and the protected areas both enjoy a certain power of administrative punishment within the scope of their duties. After studying legislation on nature reserves, we concluded that, on the one hand, nature reserves in China isManaged by type or departments or hierarchy, on the other hand, nature reserves exerts an combined management mode of integrated management and sub-sector management. On this basis, the author proposed some problems that may exist in the Institution of Chinese Sturgeon Nature Reserve,(1) the management of nature reserve agencies overlaps;(2) the nature of nature reserve management agencies is not clear;(3) powers and responsibilities of area agencies are not clear;(4) the absence of the nature reserve management mechanism, such as the guarantee mechanism of input, review mechanism, incentive and monitoring mechanisms. By analyzing the legislative experience of other countries such as the United States. Britain, Australia and Brazil and other countries on nature reserves management system, combined with the actual situation of the Yangtze River Estuary Chinese Sturgeon Nature ReserYe, the author proposes a number of reform proposals:(1) clear the management responsibilities(2) clarify the relationship of the Yangtze River Estuary Chinese Sturgeon Nature Reserve and the Chongming Dongtan bird Nature Reserve (3) establish and perfect the mechanism for the accreditation of the protected areas (4) improve the protected areas supervision and management mechanism (4) strengthen the management of construction projects involving the nature reserves.
