Research On Legal Supervision Of Non - Administrative Permission Approval

In recent years, our country is carrying on a great in strength and impetus reform of the administrative approval.With the Administrative License Law,the non-administrative license approval appear.In practice a large number of administrative approval called non-administrative license approval appearred to avoid the Administrative License Law,which provided space for the power,weakened the effect of the implementation of the Administrative Licensing Law system and also affected the process of the reform of the administrative approval system.Under the background of administration according to law,the State Council cleaned up the approval of non-administrative licensing matters several times, but the effect remains to be studied.In this paper, from the perspective of the relationship between administrative license and administrative examination and approval,this paper expounds the conception of he non-administrative license approval,and combing the development processof the non administrative licensing examination and approval: appearance,disorderly expansion, several times to be cleaned up, and analyse its reasons.Meanwhilean I analyse the present situation of the non-administrative license approval : different provisions of the same matter in different regions,invalid legal documents continue to exis,the concept of an unknown, the law is not perfect, unknown responsibility mechanism, the leadership mechanism of reform is imperfect and so on.Finally,through analysing the plight of the the non-administrative license approval’s legal supervision,put forward several countermeasures to the non-administrative license approval’s supervision: perfect the list of government power and responsibility,promote the establishment of relevant legal norms,strengthen multi-level and multi-angle supervision,dredge legal remedy approach of the non-administrative license approval.
