Environment protection has become one of the hottest issues recently. Though the WTQ has no specific agreement dealing with the environment, there are many trade provisions concerning environmental protection. As China is becoming a member in this multilateral trading system, it is extremely urgent for us to study the specific WTO legal provisions, its dispute settlement mechanism, and its legal practices particularly in environment-related trade disputes, so as to learn from them, use them after we become a WTO member, protect China from environment-related trade restrictions, improve China impaired environment, and achieve sustainable development. The dissertation follows the structure below, Brief analysis on the relationship between trade and environment, causes, nature and types of environment-related trade restrictions, and their negative effects on China international trade; The environment issue in WTO, the provisions and institution dealing with environment matterTE, WTO fundamental position on environment issue, and the relationship between WTO provisions and multilateral environmental agreements; Primary environment-related principles in WTO, their contents and application, the deficiencies in dealing with environment issue; General introduction to WTQ dispute settlement mechanism, analysis on the dispute settlement body practices under GATT and WTO, emphasis on the latest practice shrimp--turtle In the WTO illennium--round the positions held by each WTO member toward the environment issue, China position to take, and China countermeasures dealing with environment-related trade disputes, amendment in current law and policy, considering China realities and WTO provisions.
