It is difficult to reach a unanimous agreement concerning the settlement of labor disputes in the law circle of China. Disputes between management and labor and difficulties for judicial stuff to deal with conflicts arise from two main sources there is no law to resort to and the contradictions among existing law .Collective consultation and making collective contracts are objective requirements of adjusting labor relations in the socialist market economy and are common practices for adjusting labor relations in industrialized countriesHowever, there are simply too many obstacles for our country to pursue the system of collective contracts in enterprises with foreign investment ,which have relatively advanced enterprise system This definitely demands attention from our theoretical circles The present thesis attempts an in-depth anatomy of two issues which exist in adjusting labor relations in enterprises with foreign investment and enterprises with domestic investment ,and lack of efficacy of collective consultation and collective contracts On the basis of the analyses , the present researcher provides legal countermeasures to solve the problems...
