Individual Freedom And Government Power: The Rule Of Law Functions Of Civil Society Organizations

This paper is on the legal functions of the civil social organizations that Marx fund. The civil social organization is the intermediate between the individual and state in checking the power and protecting freedom.Because of the difference of individual, self-consciousness, the varieties of interent, the character of commodity exchange, the freedom becomes the core of value of constituionality.The social organizations embody the various interests in market economy in legal and order way, bear the corresponding social functions, and get the basic power of the society, hi certain case, the varieties of powers are more efficient than the government in checking different organizations of goverenment The civil social organizations are the foundations of social power that is obviously reflected in the history of Western and Chinese legality.During the time of reformation, along with the development of the market economy, the civil social organizations in China have gotten great progrecesses. Besides the unequal developments, the other characteristic of the society is the dual structures. Another outstanding one is that the level of autonomy isn't adequate, which, in most part, makes the functions of rule of law of the social organizations limited that leads to the disorder of theirs functions. The further development of the civial society relies on the further development of the economy market, the change of conceptions and functions of the government, the building of good legal enviroments, the making of seceries of new laws that can protect rights of the civil to form their own organizations, the modification and oversea comunication of the law on the regiesteration of the organizations, the international comunications and cooperations between non-government organizations, and so on.
