Hu Shi Liberalism Legal Thought

Hu Shi( 1891-1962) was an outstanding thinker on China's modern history,and was an important political personage in China in the first 60 years in the 20th century too. Hu Shi's thought and speech not only have important status in the intellectual history and culture history,but have a far- reaching impact on political life and law's system of the Guomindang. Hu Shi wrote books,issued political articles and made lectures to expound his theory and propagates political opinions and law's thought of freedom and democracy. There are more than 30 Speech and articles which were made by Hu Shi talking about law directly. It is difficult to count his works which involved law's principle and law's spirits indirectly. As a thinker,Hu Shi's thought of law is very abundant.Hu Shi was a person who ardently loved freedom. Hu Shi often posed himself as a liberalist,a lot of domestic and international scholars regard Hu Shi as a Chinese outstanding representative of liberalist of last century too. Hu Shi was competent as the spokesman of China's liberalism of last century. Liberalists,take it for core to pursue citizen personal life free and property safe,regard democratic politics as final goal,wish to set up the integrative peaceful order in the world finally. Liberalism is the foundation of Hu Shi's political philosophy and law's philosophy,Hu Shi's thought of law is the law's thought of liberalism. Liberalist law's thought is comparative to the law's thought of the Three People's Principles,the law's thought of Marxism-Leninism and the law's thought of Fascism on China's modern history.lt is different from the various law's thoughts of anarchism or totalitarianism,and different from the capitalist law's thought,the socialist law's thought and the communist law's thought that people often talk about and discuss. Law's thought of liberalism is full of thoughts of law with freedom spirit and democracy ideal. It is used to serve for citizen individual human rights,serve for national development of country and serve for peaceful order of mankind all over the world. Law's thought of Hu Shi's liberalism is the important part and concentrative representatives of law's thought of the liberalism of last century of China.This thesis is a output of the author's foundamental study on Hu Shi's thought of law systematically .Its purpose is to introduce,analysis and comment on Hu Shi's speech and thought upon law,which was based on liberalism and served for liberalism.The author hoped to promote the academic research of China's modern liberalism law's thought by finishing such a thesis.This thesis includes 8 parts,which are preface,liberalism,human rights,constitutionalism,democracy,party,freedom of thought and conclusion.The focus of this thesis is to introduce,analysis and comment the philosophical foundation,human rights thought,constitutional thought,democratic thought and party thought of Hu Shi's liberalism law,fully explaining the deep intension of liberalism and the basic system of law's thought of liberalism.
